Welcome to Bharat Doctor. These Terms and Conditions ("Terms", "Terms and Conditions") govern your relationship with the Bharat Doctor platform and services operated by Bharat Doctor Pvt. Ltd.

Please read these Terms and Conditions carefully before using our service. Your access to and use of the Service is conditioned on your acceptance of and compliance with these Terms.

1. Definitions

For the purposes of these Terms and Conditions:

• "Service" refers to the Bharat Doctor platform, including the website, mobile applications, and all associated services.
• "User" refers to any individual or entity using the Service, including Clinic Owners, Doctors, Agents, and Patients.
• "Clinic Owner" refers to the entity or individual who owns and manages a healthcare clinic and subscribes to the Service.
• "Doctor" refers to healthcare professionals registered on the platform.
• "Agent" refers to call-center representatives or AI-powered voice agents facilitating appointment bookings.
• "Patient" refers to individuals seeking healthcare appointments through the platform.
• "Credits" refers to the virtual currency used within the platform for accessing certain features and services.
• "We", "Us", "Our" refers to Bharat Doctor Pvt. Ltd.

2. User Accounts

2.1 Account Registration

• You must register an account to use certain features of the Service.
• You must provide accurate, complete, and up-to-date information during registration.
• You are responsible for maintaining the confidentiality of your account credentials.
• You are responsible for all activities that occur under your account.
• You must immediately notify us of any unauthorized use of your account.

2.2 Account Eligibility

• You must be at least 18 years old to create an account.
• Healthcare professionals must have valid credentials and licenses.
• Clinic Owners must have proper authorization to represent their clinic.
• You must comply with all applicable laws and regulations in your jurisdiction.

2.3 Account Termination

We reserve the right to suspend or terminate your account at any time for:

• Violation of these Terms and Conditions
• Fraudulent, abusive, or illegal activity
• Extended periods of inactivity
• Non-payment of fees
• Any other reason we deem appropriate

3. Credit System

3.1 Credit Purchase

• Credits must be purchased in advance to access certain platform features.
• Credit packages are available at various price points.
• Credits are non-refundable except as required by law.
• Credits do not have cash value and cannot be exchanged for money.
• All credit purchases are final upon completion of payment.

3.2 Credit Usage

• Credits are deducted for each appointment booking made through the platform.
• The number of credits required per booking depends on the service type and agent model used.
• Credits expire 12 months from the date of purchase unless otherwise specified.
• Expired credits cannot be recovered or refunded.

3.3 Credit Balance

• You can view your current credit balance in your account dashboard.
• We will notify you when your credit balance is low.
• If your credit balance reaches zero, certain features will become unavailable.

4. Service Features and Usage

4.1 Appointment Booking

• The platform facilitates appointment scheduling between patients and healthcare providers.
• We do not guarantee the availability of doctors or appointment slots.
• Appointment confirmations are subject to doctor availability and clinic policies.
• Patients and clinics are responsible for managing their appointments.

4.2 Call-Agent Services

• Call-agent services may be provided by human agents or AI-powered voice agents.
• Calls may be recorded for quality assurance and training purposes.
• We are not responsible for miscommunications or errors made by agents.
• Agent availability may vary based on time and demand.

4.3 Calendar Integration

• You may integrate third-party calendar services at your own discretion.
• We are not responsible for synchronization issues with external calendars.
• You are responsible for managing calendar permissions and access.

5. Payment Terms

5.1 Pricing

• All prices are listed in Indian Rupees (INR) unless otherwise specified.
• Prices are subject to change with prior notice.
• Subscription fees and credit packages are non-refundable except as required by law.
• You are responsible for any applicable taxes on your purchases.

5.2 Payment Methods

• We accept payment through credit/debit cards, UPI, net banking, and other approved methods.
• Payment processing is handled by third-party payment gateways.
• You authorize us to charge your selected payment method for all purchases.

5.3 Billing

• Invoices will be provided for all transactions.
• You are responsible for reviewing and disputing charges within 30 days.
• Failed payments may result in service suspension.

6. User Responsibilities

6.1 Prohibited Activities

You agree not to:

• Use the Service for any illegal purpose or in violation of any laws
• Violate the intellectual property rights of others
• Upload malicious code, viruses, or harmful content
• Attempt to gain unauthorized access to the Service or other accounts

6.2 Healthcare Professional Responsibilities

Healthcare professionals using the Service must:

• Maintain valid and current professional licenses
• Provide accurate information about their qualifications and specializations
• Comply with all applicable medical and healthcare regulations
• Maintain patient confidentiality and privacy
• Honor appointments scheduled through the platform

6.3 Clinic Owner Responsibilities

Clinic Owners must:

• Ensure accurate clinic information and operating hours
• Manage doctor schedules and availability
• Maintain adequate credit balance for continuous service
• Supervise and train staff using the platform
• Comply with healthcare facility regulations

7. Intellectual Property

7.1 Our Intellectual Property

• The Service and its original content, features, and functionality are owned by Bharat Doctor Pvt. Ltd.
• The Service is protected by copyright, trademark, and other intellectual property laws.
• You may not copy, modify, distribute, or create derivative works without our permission.

7.2 User Content

• You retain ownership of content you upload to the Service.
• By uploading content, you grant us a license to use, store, and display that content for Service operation.
• You represent that you have the right to upload and share any content you submit.
• We may remove any content that violates these Terms or is deemed inappropriate.

7.3 Trademarks

• "Bharat Doctor" and related marks are trademarks of Bharat Doctor Pvt. Ltd.
• You may not use our trademarks without prior written permission.

8. Privacy and Data Protection

• We handle healthcare data in accordance with applicable privacy and healthcare regulations.
• Healthcare professionals must comply with patient confidentiality requirements.

9. Disclaimers and Limitations of Liability

9.1 Service Availability

• The Service is provided "as is" and "as available" without warranties of any kind.
• We do not guarantee uninterrupted or error-free service.
• We may modify, suspend, or discontinue the Service at any time.
• Scheduled maintenance may temporarily affect Service availability.

9.2 Medical Disclaimer

• Bharat Doctor is an appointment management platform, not a healthcare provider.
• We do not provide medical advice, diagnosis, or treatment.
• We are not responsible for the quality of healthcare services provided by doctors or clinics.
• All medical decisions should be made in consultation with qualified healthcare professionals.

9.3 Limitation of Liability

To the maximum extent permitted by law:

• We are not liable for any indirect, incidental, special, consequential, or punitive damages.
• Our total liability for any claims arising from the Service shall not exceed the amount you paid in the last 12 months.
• We are not liable for losses resulting from unauthorized access to your account.
• We are not liable for third-party services, content, or actions.

10. Indemnification

You agree to indemnify, defend, and hold harmless Bharat Doctor Pvt. Ltd., its affiliates, officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including legal fees) arising from:

• Your use of the Service
• Your violation of these Terms
• Your violation of any rights of another party
• Your content or information submitted to the Service
• Healthcare services provided by you or through your clinic

11. Dispute Resolution

11.1 Governing Law

These Terms shall be governed by and construed in accordance with the laws of India, without regard to conflict of law provisions.

11.2 Jurisdiction

Any disputes arising from these Terms or the Service shall be subject to the exclusive jurisdiction of the courts in Bangalore, Karnataka, India.

11.3 Arbitration

For disputes involving amounts less than ₹5,00,000, parties agree to first attempt resolution through arbitration in accordance with Indian Arbitration and Conciliation Act, 1996.

12. Modifications to Terms

We reserve the right to modify these Terms at any time. When we make changes:

• We will update the "Last Updated" date at the top of this page
• We will notify users via email or platform notification
• Material changes will be highlighted in the notification
• Continued use of the Service after changes constitutes acceptance

If you do not agree to the modified Terms, you must stop using the Service.

13. Termination

• Termination does not relieve you of payment obligations for services already rendered.
• Unused credits will be forfeited upon account termination.

13.2 Termination by Us

We may terminate or suspend your account immediately for:

• Fraudulent or illegal activity
• Non-payment
• Extended inactivity
• Any conduct we deem harmful to the Service or other users

13.3 Effect of Termination

Upon termination:

• Your right to use the Service will cease immediately
• We may delete your account data after a reasonable period
• You remain liable for any obligations incurred before termination
• Provisions that should survive termination will remain in effect

14. Third-Party Services

The Service may contain links to or integrate with third-party services, including:

• Payment gateways (Stripe, Razorpay, PayU)
• Calendar services (Google Calendar, Outlook)
• Telephony providers (Twilio, Exotel)
• Analytics and monitoring tools

We are not responsible for:

• The content, privacy policies, or practices of third-party services
• Any damage or loss caused by third-party services
• The availability or reliability of third-party services

15. General Provisions

15.1 Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and Bharat Doctor regarding the Service.

15.2 Severability

If any provision of these Terms is found to be unenforceable, the remaining provisions will continue in full force and effect.

15.3 Waiver

Our failure to enforce any right or provision of these Terms will not be considered a waiver of those rights.

15.4 Assignment

You may not assign or transfer these Terms without our written consent. We may assign our rights and obligations without restriction.

15.5 Force Majeure

We are not liable for any failure to perform our obligations due to circumstances beyond our reasonable control.

These Terms are written in English. Any translations are provided for convenience only. In case of conflicts, the English version prevails.
